1. Definitions

For the purposes of these Terms and Conditions, the following terms carry the meanings set out below:

• "Escapement" / "We" / "Us" / "Our" — refers to Escapement, a watch repair and restoration business operating at 12 Rat-U-Thit 200 Pi Road, Patong, Phuket 83150, Thailand.
• "Client" / "You" / "User" — refers to any individual or entity who contacts us, visits our website, or engages our services.
• "Services" — refers to all watch-related repair, maintenance, and restoration work performed by Escapement, including Quartz Service & Battery Care, Refinish & Resistance Package, and Vintage Revival Program.
• "Timepiece" / "Watch" — refers to any horological item submitted to Escapement for assessment or work.
• "Agreement" — refers to these Terms and Conditions together with any written service confirmation provided by Escapement.
• "Website" — refers to the online presence maintained at escapement.blog.

2. Acceptance of Terms

By contacting Escapement through any channel, submitting a watch for assessment, or proceeding with any service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

To engage our services, you confirm that you are at least 18 years of age and possess the legal capacity to enter into a binding agreement. If you are acting on behalf of another person or organisation, you confirm that you have the authority to do so.

These Terms apply alongside any written quotation, work order, or service confirmation issued by Escapement. In the event of a conflict, the specific written service confirmation takes precedence.

3. Service Description

Escapement provides specialist watch care across three principal service tiers, each carried out by trained horological professionals in our Patong workshop.

All services are subject to a pre-work evaluation. We will communicate our findings and, where applicable, any revised scope or pricing before commencing work. No work proceeds without your agreement.

Our services are offered to clients in Thailand and internationally. Collection and delivery arrangements for clients outside of Phuket can be discussed directly with our team. Escapement does not commit to specific completion timescales without prior written agreement.

The scope of each service is described on our website and in any written quotation. We reserve the right to identify additional requirements during assessment and will communicate these to you promptly.

4. User Responsibilities

When engaging with Escapement or submitting a timepiece for service, you agree to the following:

• — Provide accurate information about the watch, including its history, known faults, and any previous repair work.
• — Confirm that you are the lawful owner of the timepiece or have the owner's explicit consent to submit it for service.
• — Communicate any preferences, concerns, or constraints clearly at the outset of the engagement.
• — Collect your timepiece within 30 days of receiving notification that work is complete. Extended storage may incur additional charges.
• — Refrain from making representations about Escapement that are factually inaccurate or misleading.
• — Use our website only for lawful purposes and in a manner that does not infringe the rights of others.

5. Intellectual Property

All content on the Escapement website — including text, photography, layout, and visual design — is the intellectual property of Escapement or is used with appropriate permission. Nothing on the site is to be reproduced, adapted, or distributed without our prior written consent.

Any service photography or documentation produced during the course of work on your timepiece (such as staged photographs provided as part of the Vintage Revival Program) remains the property of Escapement but may be used freely by you for personal purposes.

You grant Escapement a limited licence to use any photographs or information you provide solely for the purpose of carrying out the agreed service. This licence does not extend to public use without your consent.

6. Payment Terms

All service fees are quoted and payable in Thai Baht (฿). Our published service tiers are as follows:

Where additional work is identified during assessment, a revised quotation will be provided before any further costs are incurred. Payment in full is required upon collection of the timepiece unless a written deposit arrangement has been agreed in advance.

Accepted payment methods will be confirmed at the point of service. Escapement does not store payment card details.

Once work has commenced, cancellation may result in a partial charge reflecting the work completed to that point. Escapement will communicate the applicable charge clearly before it is applied.

Escapement provides its services with reasonable skill and care. However, we do not make any representations about specific outcomes, and no assurance of a particular result is given or implied.

Our website content is provided for general information only and should not be relied upon as technical advice for your specific timepiece. Where individual guidance is needed, we welcome direct enquiries.

Older timepieces, in particular, may carry pre-existing vulnerabilities that are not apparent before work commences. We will communicate any such findings promptly and will not proceed with work that we believe carries unreasonable risk without your informed consent.

9. Limitation of Liability

To the fullest extent permitted by Thai law, Escapement's liability arising from any service engagement is limited to the value of the service fee paid for that specific service. We do not accept liability for indirect or consequential loss, including sentimental value, anticipated savings, or loss of use.

In the event of damage attributable to our negligence, our liability is limited to repair or reasonable compensation for the affected item, assessed fairly against its pre-service condition.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.

10. Indemnification

You agree to indemnify and hold harmless Escapement, its staff, and representatives from any claims, losses, or expenses arising from your breach of these Terms, including any misrepresentation about ownership of a submitted timepiece.

This indemnification obligation does not apply where the claim arises from our own negligence or wilful misconduct.

11. Termination

Either party may withdraw from a service engagement before work commences without penalty. If you wish to withdraw after work has begun, please contact us to discuss the status of your timepiece and any applicable charge.

Escapement reserves the right to decline or discontinue a service where we reasonably believe there is a concern about the provenance of a timepiece or the safety of our staff.

Provisions relating to intellectual property, payment obligations, and limitation of liability survive the termination of any service agreement.

12. Dispute Resolution

If a concern arises in connection with our services, we encourage you to contact us directly in the first instance. Most matters can be resolved through open conversation, and we take all client concerns seriously.

These Terms are governed by the laws of Thailand. Any dispute that cannot be resolved informally may be referred to the courts of Phuket Province, Thailand, whose jurisdiction the parties accept.

Where both parties agree, disputes may instead be referred to a mutually acceptable mediator before any court proceedings are commenced.

13. General Provisions

• Entire Agreement. These Terms, together with any written service confirmation, constitute the full agreement between the parties and supersede all prior discussions or representations.
• Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
• Waiver. Our failure to enforce any provision at any time does not constitute a waiver of that provision.
• Assignment. You may not transfer your rights under these Terms without our prior written consent. We may transfer our obligations in connection with a business reorganisation, provided that your rights are not diminished.
• Notices. Formal notices should be directed to [email protected] or in writing to our workshop address.

We may update these Terms from time to time to reflect changes in our services, applicable law, or operational practice. When we do, we will update the "Last Updated" date at the top of this page.

Where changes are material, we will endeavour to communicate them clearly on our website. Continued use of our services following an update constitutes acceptance of the revised Terms.

We recommend reviewing these Terms periodically. The version in effect at the time of your service engagement is the version that applies to that engagement.
